NAHMA HUD Update: Initial Implementation Guidance for HOTMA

HUD has released initial implementation guidance for the Housing Opportunity Through Modernization Act of 2016 (HOTMA), which was signed into law by President Obama on July 29, 2016.

HOTMA altered several HUD regulations, including the frequency of income certifications for tenants living on a fixed income. This guidance seeks to advise HUD program participants and interested members of the public on this and other statutory provisions under HOTMA. Some provisions are effective immediately while others will require further action by HUD to become effective or to be used by HUD program participants.

 

This document does not provide a section-by-section analysis of HOTMA, nor does it provide guidance on all sections. We recommend that you review this guidance in conjunction with a recent NAHMAnalysis on HOTMA for a better understanding of the new law.
